Karen Bennett-Clayton quoted in The Lawyers Weekly about recent Internet libel decision
Halifax partner Karen Bennett-Clayton was quoted in the recent article, ‘Despicable’ web campaign means blanket ban, by John Schofield.
This piece, featured in the latest issue of The Lawyers Weekly, outlines a recent decision out of Ontario in which a permanent injunction was imposed on a man who was found guilty of online defamation. Karen states that this decision is particularly intriguing, because the defendant was found guilty of both libel and the recent privacy tort of inclusion upon seclusion. “That’s a very interesting development in the breach of privacy bar,” notes Karen, “I think that this case expanded intrusion upon seclusion to overlap potentially with defamation claims.”
