Karen Bennett-Clayton involved in significant civil action appeal decision
Following a recent decision from the Nova Scotia Court of Appeal, lawyers can continue to ask witnesses to provide collision sketches at pretrial discovery hearings. Halifax partner Karen Bennett-Clayton successfully argued that, “it is right and proper to use such demonstrative evidence as part of the fact-finding process of discovery examinations.” In an interview with The Lawyer’s Daily, Karen stated that this particular decision could be applied to discoveries in other areas as well: “[it] gives counsel absolute comfort in knowing that what has been general practice for many years can carry on as usual now with the confirmation from the Court of Appeal.”
