Charlottetown partner Jonathan Coady has published an article, “The Time Has Come: Standard of Review in Canadian Administrative Law,” in volume 68 of the University of New Brunswick Law Journal. The volume examines emerging issues in administrative and constitutional law and includes articles from a number of leading academics in these areas.
In his article, Jonathan shares the perspective of a practitioner and suggests that a single standard of review for reasonableness would bring more consistency to the judicial review of governmental decisions. Clients, lawyers and courts would all be focused on the merits of those decisions. And unproductive “lawyer’s talk” – to borrow a phrase from a leading judge – would be significantly reduced.
