Cathy has an extensive litigation practice with particular focus on all aspects of commercial litigation, employment law and Indigenous Relations.  She appears regularly as both trial and appellate counsel before all levels of New Brunswick Courts and successfully guides clients through high-stakes litigation matters.  Her professional experience includes:

Commercial Litigation

• representing clients in litigation involving major contractual disputes;
• representing manufacturers and suppliers in relation to product liability litigation involving both consumer and industrial products;
• acting on behalf of corporations, directors and shareholders in oppression remedies disputes;
• representing beneficiaries, executors and trustees in estate litigation disputes; and
• representing clients in relation to banking, finance and insolvency litigation.

Employment

• representing employers in executive level wrongful dismissal litigation;
• defending employers in OHS prosecutions;
• defending employers in response to human rights complaints; and
• counselling employers regarding all aspects of non-unionized employee relations including employment standards, performance management, terminations, OHS training/ compliance and prosecutions, human rights, workers’ compensation and respectful workplace management.

Indigenous Relations

• acting on behalf of Industry-based clients in ongoing Aboriginal title litigation;
• acting on behalf of both the Crown and Industry in litigation related to consultation requirements; and
• advising Industry based clients regarding consultation and accommodation requirements and negotiation of benefit agreements.

Environmental

• appearing on behalf of clients in relation to environmental based prosecutions and advising clients in relation to regulatory compliance, due diligence reviews and management of contaminated sites.
