James LeMesurier, QC & Danielle Harding counsel in precedent setting police conduct ruling
James LeMesurier, QC and Danielle Harding represented the New Brunswick Police Commission in an arbitration that resulted in the dismissal of Constable Jeff Smiley of the Fredericton Police. Constable Smiley was found to have breached the code of Professional Conduct on four counts of misconduct relating to domestic violence and firearms. While police officers in New Brunswick have been punished before for misconduct, this is the first time an arbitrator under the Police Act has imposed dismissal.
